Welcome to Mspark, an innovative real-time chat application developed by Mataaf Technologies. These Terms and Conditions (“Terms”) govern your access to and use of the Mspark mobile application (“App”). By installing or using the App, you agree to be legally bound by these Terms. If you do not agree to these Terms, please uninstall the App and discontinue use.

These Terms form a legal agreement between you (“User”) and Mataaf Technologies (“we,” “us,” or “our”).

2. Eligibility

To use Mspark, you must be at least 16 years of age or the age of legal consent in your country, whichever is higher. By agreeing to these Terms, you confirm that you meet the age requirement.

3. Account Registration & Responsibilities

When you register for Mspark, you agree to:

  • Provide truthful, accurate, and complete information;
  • Keep your login credentials confidential;
  • Be solely responsible for activity under your account;
  • Promptly notify us in case of unauthorized access or security breach.

We reserve the right to suspend or terminate your account if we suspect any breach of these Terms or any illegal behavior.

4. Permitted Use

You may use Mspark solely for personal, non-commercial purposes. You agree not to:

  • Use the app in a way that violates applicable laws or regulations;
  • Upload, transmit, or distribute any content that is abusive, harassing, defamatory, vulgar, obscene, or harmful;
  • Attempt to gain unauthorized access to the system or interfere with the App’s operations;
  • Use the App for any form of spam, advertisement, or unsolicited messaging.

5. Content Ownership & Usage

You retain ownership of any messages, images, or media you share on Mspark. However, by using our services, you grant us a non-exclusive, royalty-free license to use, host, store, reproduce, and display your content for the purpose of operating and improving our services.

We reserve the right (but are not obligated) to review, screen, or remove any content at our discretion.

6. Data Collection & Privacy

Mspark collects and processes the following user data:

  • Full Name
  • Email Address
  • Profile Photo
  • Messages and Chat Metadata
  • Device Information and Usage Logs

We use this information to:

  • Provide secure and personalized chat services
  • Monitor performance and fix bugs
  • Ensure compliance with our terms and policies

Your use of Mspark is also governed by our detailed Privacy Policy.

7. Third-Party Services

Mspark integrates with third-party platforms, such as Google Firebase, for backend infrastructure, authentication, and data storage. By using Mspark, you agree to abide by the terms and privacy policies of such third parties.

We are not responsible for any acts or omissions of these third-party providers.

8. Modifications and Updates

We may, from time to time, modify or update these Terms, the App’s features, or functionality. You will be notified of any major changes via the App or registered email. Continued use of the App constitutes acceptance of the revised Terms.

9. Termination

We reserve the right to suspend or permanently terminate your access to Mspark at our sole discretion, without notice, especially in cases of abuse, legal violations, or breach of these Terms.

10. Disclaimer of Warranties

Mspark is provided on an “AS IS” and “AS AVAILABLE” basis. Mataaf Technologies disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free service.

11. Limitation of Liability

Under no circumstances shall Mataaf Technologies be liable for any indirect, incidental, special, or consequential damages arising out of your use or inability to use the App. Our total liability to you shall not exceed the amount you paid us (if any) to use the App.
